Acceptable Use Policy (AUP)

No Illegal, Harmful, or Offensive Content

Users are prohibited from using our services or website for any illegal, harmful, fraudulent, infringing, or offensive purposes. This includes not only the act of using such content but also encouraging, promoting, or instructing others to do so. The following actions and types of content are explicitly banned:

  • Illegal, Harmful, or Fraudulent Activities: Engaging in any illegal acts, breaching others’ rights, or causing harm to individuals or our reputation. This includes sharing or promoting child pornography, distributing fraudulent goods or schemes, running get-rich-quick promotions, Ponzi or pyramid schemes, and phishing or pharming activities.
  • Infringing Content: Sharing material that violates or misappropriates the intellectual property or proprietary rights of others is strictly prohibited.
  • Offensive Content: Any material that is defamatory, obscene, abusive, invasive of privacy, or otherwise objectionable. This includes content that constitutes child pornography or illustrates non-consensual sexual acts.
  • Harmful Content: You must not share or utilize any content or technology that may damage, disrupt, or intercept any system, program, or data. This includes harmful entities like viruses, Trojan horses, worms, time bombs, or cancelbots.
  • Illegal Export: Exporting software, encryption technology, or technical information that violates international or regional export laws is forbidden.
  • Data Privacy Misuse: Misusing personal information or data that contravenes applicable privacy laws and regulations is not allowed.

Security Violations using our services to compromise the security or integrity of any network, computer system, or communication technology is not permitted. The following activities are expressly forbidden:

  • Unauthorized Access: Accessing any system without permission, including attempts to test or probe system vulnerabilities or bypass security measures.
  • Interception: Monitoring data or traffic on a system without the necessary permissions.
  • Falsification of Origin: Forging packet headers, email headers, or any part of a message to misrepresent its origin or route. Using aliases and authorized anonymous remailers is permissible.
  • Account Security: You must not share your account password with others or enable others to use your account, including family members when work is conducted from home. Circumvention of user authentication or security measures of any host, network, or account is strictly against policy.

Network Abuse

You should only establish network connections with users, hosts, or networks if you have the necessary permissions. The following activities are strictly prohibited:

  • Monitoring or Crawling: Any kind of monitoring or crawling that disrupts or impairs the system being examined.
  • Denial of Service (DoS): Flooding a target with communication requests to the point where it cannot manage legitimate traffic or responds so slowly that it becomes ineffective.
  • Intentional Interference: Disrupting the normal operation of any system, including intentional overloads through methods like mail bombing, news bombing, broadcast attacks, or flooding techniques.
  • Operating Certain Network Services: Running network services such as open proxies, open mail relays, or open recursive domain name servers.
  • Avoiding System Restrictions: Using manual or electronic methods to bypass any restrictions on a system, including those related to access and storage.

SMTP

You are not permitted to distribute, publish, send, or help distribute unsolicited mass emails, messages, promotions, advertisements, or solicitations—commonly known as “spam.” This includes any form of commercial advertising or informational announcements. Furthermore, you must not engage in harassment through email regardless of message content, frequency, or size. It is also essential not to modify or hide email headers or impersonate someone else as a sender without their clear consent. Lastly, you will not collect responses to messages from other internet service providers if those messages breach this Policy or the acceptable use policy of that specific provider.


Copyright Infringement & DMCA Policy

  • Forwarding of Notices
    All valid DMCA or copyright-related notices received by us are forwarded directly to the corresponding account owner for appropriate action. Customers are solely responsible for reviewing these notices and resolving any claims related to their hosted content.

  • Use of Cloudflare Proxy (Strong Recommendation)
    Customers who anticipate receiving DMCA notices are strongly advised to proxy their services through Cloudflare.

    • DMCA notices received via Cloudflare will always be forwarded to the customer and treated as complete and correctly submitted.

    • Complaints submitted directly by the complainant (i.e., not through Cloudflare) may be handled differently and can result in additional scrutiny.

    • Remaining behind Cloudflare is strongly recommended to ensure uninterrupted service and to reduce operational impact.

  • High-Volume Complaints From the Same Complainant
    If an unusually high number of DMCA notices is received from the same complainant regarding the same service, and the service is not behind Cloudflare, we may be forced to take action. This can include temporary suspension or other mitigation steps to protect our network and abuse reputation.

  • Jurisdiction & Enforcement Leniency
    While we respect international copyright laws, our enforcement priority is based on Nigerian jurisdiction.

    • We are generally lenient toward notices based solely on the laws of foreign countries unless:

      • The complaint originates from within Nigeria, or

      • The claim is specifically based on Nigerian law.

    • Complaints meeting these criteria will be treated with elevated seriousness.

  • Escalation to Suspension or Termination
    DMCA-related issues will not result in account termination unless one or more of the following conditions are met:

    • Forwarded complaints consistently originate from the same complainant over time.

    • We receive a lawful request or directive from Nigerian authorities.

    • The reported content negatively affects our brand, reputation, ethics, or the values we operate under.

    • The customer fails to act upon repeated forwarded notices from a single complainant and demonstrates a pattern of non-compliance.

  • Customer Responsibility
    Customers must take timely action to investigate and address any forwarded copyright claims. Failure to do so may result in account-level action, including suspension, access restriction, or termination under the criteria listed above.

Complaints submitted to other departments may experience delays. Only notices sent to this address are guaranteed to enter our formal review process.


Fair Usage/Shared Cores

You are entitled to a specific allocation of physical cores, and you’ll only have the right to use more than that during designated burst periods.

To clarify, a virtual core (vCore) is equivalent to 1/4 of a physical thread or 1/8 of a physical core. This means you’ll need 4 vCores for unrestricted access to a physical thread, and 8 vCores to fully utilize a physical core. The only time these limits can be exceeded is if you opt for a DVS plan that locks specific physical cores to your instance.

Maintaining consistent usage at 100% or having regular patterns of hitting 100% usage on your purchased plan is not permitted.


Resource Usage

  • Fair Resource Usage: Users must ensure that their use of services does not negatively impact the performance or availability of services for other users. Excessive or abusive resource consumption, including CPU, memory, disk I/O, and network bandwidth, is prohibited.

Compliance with Laws

  • Compliance with Laws: Users must comply with all applicable laws, regulations, and industry standards while using our services. This includes, but is not limited to, data protection laws, export control laws, and intellectual property laws.

Reporting Abuse

  • Reporting Abuse: Users are encouraged to report any violations of this Acceptable Use Policy or other abusive behavior. Reports can be made by contacting our support team with relevant details and evidence.

Enforcement

  • Enforcement Actions: We reserve the right to take appropriate action in response to violations of this policy. This may include throttling, suspending or terminating user accounts, blocking access to services, or taking legal action. Users will be notified of any enforcement actions taken against their accounts.

Throttling

  • Throttling: Our servers run an automated scanning and throttling module which checks usage once a minute every 24 hours. Should a server be detected more than our allowed threshold within any 24 hour period as exceeding their allocation, the instance will automatically be throttled for 5 days.
    When released, the same process will continue if detected again.

Privacy and Confidentiality

  • Privacy and Confidentiality: Users must respect the privacy and confidentiality of others. This includes not sharing or disclosing sensitive information without proper authorization and adhering to data protection and privacy regulations.

Use of Services

  • Permitted Use of Services: Our services are intended for legitimate and lawful purposes only. Users must not use our services for activities that are deceptive, harmful, or interfere with the normal use of the services by others.

Actions That Can Lead To Suspension/Termination

  • Open proxies
  • Tor exits
  • IP alerts/complaints going unanswered or not resolved
  • Requests from law/govt agencies regarding online behavior/data
  • Unpaid bills for services rendered
  • Constant or maintained CPU bursts on non-dedicated plans
