Your Obligations

Data Backup Obligations:

You are responsible for backing up your data in accordance with our General Terms and Conditions.
Obligation To Inform:

If you suspect that a third party is using your platform or web space without authorization, you must inform us immediately.
Fair Play Obligations:

You agree not to offer or disseminate copyrighted content without authorization.
-
You agree not to use P2P exchanges, download services, or streaming services for the illegal dissemination of copyrighted materials.
-
You agree not to provide links that point to P2P exchanges, download services, streaming services, or their contents.
Fair Use Obligations:
-
You agree to avoid excessive consumption of resources that may lead to a drop in performance of the platform, suspicion of fraudulent behavior, or impairment of the rights of third parties.

You agree to avoid any disruption that would lead to a drop in performance of the platform and affect the provision of the service or the rights of third parties sharing the infrastructure.
Crypto Mining:

You agree not to use the resources and servers provided by SiteHUB Agency Ltd to operate applications for mining cryptocurrencies.
Liability:
-
Importing and installing operating systems, images, and other external content is done at your own risk.

We assume no liability for third-party content and applications or damage resulting from the installation and use of third-party materials.
Obligations to Co-operate:

You agree to follow the technical instructions provided by us.
-
You agree to cooperate and follow SiteHUB‘s instructions regarding software upgrades to maintain the security and stability of the services provided.

We accept no liability for the consequences resulting from failure to follow these instructions.
License Obligations:

You agree to fulfill all license requirements, including those from third parties.

You must remain in possession of the required original software licenses. We may request proof of licenses at any time.

You acknowledge that the trademarks and other intellectual property rights for third-party licenses used on our cloud platform belong to the respective third parties.

Our Rights
-
Migration Rights:
-
We retain the right to migrate your server, server software, or any parts thereof for technical or security reasons (e.g., end-of-life of software, termination of support).
-
We reserve the right to offer an alternative version of the application that we deem most suitable and to modify the available applications at any time, in line with new versions or if vulnerabilities are detected. These changes will be communicated via your management portal.
Access and Cancellation Rights:

We reserve the right to disconnect the server from the network without prior notice if you have breached your obligations. You will be promptly notified if such action is taken.

If you have breached your obligations, we reserve the right to cancel your contract without notice.
Maintenance and Upgrades:
-
We reserve the right to perform scheduled maintenance and upgrades to ensure the security, stability, and performance of our services. Customers will be informed of maintenance schedules in advance.
Modification of Terms:

We reserve the right to modify these terms and conditions at any time. Customers will be notified of any changes, and the updated terms will be published on the management portal.
Suspension of Services:

We reserve the right to suspend services in cases of suspected fraud, abuse, or any activity that jeopardizes the integrity of our infrastructure or the security of our services.
Data Access and Privacy:

We reserve the right to access data and logs for troubleshooting and security purposes. Data will be handled in accordance with our privacy policy, ensuring customer confidentiality.
Resource Allocation:

We reserve the right to allocate resources as necessary to maintain optimal performance and service levels. This may include reallocation of bandwidth, storage, or other resources to ensure fair use and prevent abuse.

Throttling:
-

Our servers run an automated scanning and throttling module which checks usage once a minute every 24 hours. Should a server be detected more than our allowed threshold within any 24 hour period as exceeding their allocation, the instance will automatically be throttled for 5 days.
When released, the same process will continue if detected again.

Promotional Offers
-
Unmanaged Services:
-
Our promotional offers, like most of our virtualized services, are unmanaged and require a sound knowledge of administering server systems.
Refund Policy:
-
Promotional offers do not qualify for a 5-day refund guarantee.
-
Promotional offers are not refundable. If you are unsure about the stability of the network, please consider the following options:
-
Use our Looking Glass tool to evaluate our network.
-
Contact support to request 1 hour access to assess the service. A 300MB RAM server will be provided with 10GB Bandwidth.
-
Purchase a similar plan and benefit from the 5-day refund guarantee. If satisfied, the plan can be canceled and the promotional offer purchased (if still available).

Affiliates: Promotional offers do not qualify for affiliate payouts. This includes, but is not limited to:
-
Services purchased at discounted rates through limited-time promotions, coupon codes, or other offers
-
Transactions involving free trials or complimentary services.
- Any special pricing arrangements outside of standard rates.
Customer Responsibilities:
-
You are solely responsible for updating the operating systems and application software installed on the server at your own cost and risk.
-
You are responsible for installing reliable security software and keeping it updated to prevent hackers from abusing insufficiently secured or “open” networks.
Recurring Pricing:
-
Promotional offers recur at the advertised price for the life of the plan.
Service Limitations:
-
Promotional offers may have specific limitations in terms of resources (e.g., CPU, RAM, bandwidth) compared to standard plans. Please review the offer details carefully before purchasing.
Support Availability:
-
While our support team is available to assist with general inquiries, promotional offers do not include dedicated technical support. Customers are expected to have the necessary expertise to manage their VPS.
Service Continuity:
-
We strive to provide continuous service availability, but promotional offers may be subject to maintenance windows and service interruptions. Customers will be notified of scheduled maintenance in advance.

VM Stacking
-
Customers are allowed to stack Virtual Private Servers (VPS) regardless of whether the offer is promotional or non-promotional.
-
If a customer does not wish to stack their IPv4 addresses, they have the option to return them for a $0.50 discount off the price. Customers also have the flexibility to repurchase IPv4 addresses at a later date for the same price (applicable only to the stacked instance).
Refunds for Unwanted/Unneeded Stacked IPs:
-
To receive a refund for stacked IPv4 addresses that are no longer wanted or needed, customers must open a support ticket.
-
Once the support ticket is processed, the refund amount will be credited to the customer’s account balance.
- We will refund stacked IPv4s at a cost of $0.50/IP/m and IPv6 for $0.00
Backups
VPS Backup Service:

Our VPS Backup service offers a reliable way to safeguard your server and device data. To activate this feature, simply contact our support team to select a plan. You can manage your backups through the Backup tab in your VPS Panel. Please note that VPS Backup is a paid service (although it may be included with selected plans as standard).
Backup Process:
-
Your entire VPS, including the operating system, will be securely backed up and stored off-site. We provide the necessary platform for your VPS Backup and ensure it’s updated as required. However, we cannot be held responsible for any loss or inadvertent deletion of data from the backups, nor can we guarantee the retrieval of such data.
Liability
-
SiteHUB will not be liable for data loss, business interruptions, or any damages arising from the use of the VPS/DVS backup service, including any failure to meet your expectations. Access to VPS/DVS Backups is restricted exclusively to you and those you authorize.
Restore Option
-
When you purchase backup plans from us, SiteHUB provides a restore option. However, please understand that we cannot guarantee these backups will always be accessible or free from corruption. It’s strongly recommended that you maintain your own independent backups as a precaution.
Backup Availability

Backups may be present with select plans and active. While active, you are welcome to utilize this feature, but there are no guarantees that it will remain in place. Please do not rely on this option as your sole backup source if the feature has not been purchased.
Bandwidth

Bandwidth Allocation:
-
Each plan includes a specific amount of allocated bandwidth. Users are encouraged to monitor their bandwidth usage to ensure they remain within the limits of their plan.

Exceeding Bandwidth Allocation:
-
Upon exhausting all allocated bandwidth available with a plan, the user’s port speed will be limited to 10Mbps. This ensures continuity of service without completely suspending access.

Service Continuity:
-
The port speed limitation to 10Mbps will remain in effect until either: a. Additional bandwidth is purchased to remove the limit. b. The plan is refreshed at the beginning of the next billing cycle.

Purchasing Additional Bandwidth:
-
Users have the option to purchase additional bandwidth at any time. This additional bandwidth will remove the port speed limitation and restore the original bandwidth speed as per the user’s plan.

Monthly Refresh:
-
At the beginning of each new billing cycle, the allocated bandwidth for each plan is refreshed. Any port speed limitations will be lifted, and users will resume their original bandwidth speed.

TOR
-
Permitted Use:
-
We allow our virtual servers to be used as TOR exit nodes. This means users can configure their virtual servers to act as exit points for TOR traffic, enabling anonymous browsing and communication.

Prohibited Use:
-
Under no circumstances do we allow our virtual servers to be used as TOR relays or for any other purpose related to the TOR network aside from functioning as exit nodes.
-
Users found using their virtual servers as TOR relays or for any other unauthorized TOR-related activities will have their specific service immediately reviewed and potentially terminated.

Enforcement:

The use of virtual servers as TOR relays or for unauthorized TOR-related activities is strictly prohibited.
-
Users found in violation of this policy will have their specific service terminated without any refund.
-

Monitoring and Compliance:
-
We reserve the right to monitor network traffic to ensure compliance with this policy.
-
Users are responsible for ensuring their use of TOR complies with all applicable laws and regulations.
-
CPU Throttling
-
CPU Allocation:
-
Servers that are not designated as DVS (Dedicated Virtual Servers) are allocated 1/4 or 25% of a physical core’s thread. Given that our cores are multithreaded, there are 2 threads in each physical core.

Overutilization of CPU Resources:
-
If a non-DVS server experiences overutilization of CPU resources for a sustained period, to the extent that it begins to affect neighboring servers, action will be taken to throttle the CPU usage rather than suspension.

CPU Throttling:
-
In the event of sustained overutilization, the server’s CPU allocation will be throttled to 20% of its current allocation.
-
This throttling will result in slower responses to commands and loading speeds of applications, sites, and programs.
-

Monitoring and Enforcement:
-
CPU usage will be continuously monitored to identify instances of overutilization.
-
Appropriate measures, including CPU throttling, will be enforced to ensure fair resource distribution and to maintain overall system performance.
-

User Responsibility:
-
Users are responsible for managing their CPU usage within the allocated limits.
-
Users are encouraged to optimize their applications and workloads to prevent overutilization and ensure smooth operation.

DNS Servers
We allow the use of DNS servers on our infrastructure, provided the following conditions are met:
- No Open Resolvers:
DNS servers must not be configured as open resolvers. Any DNS server found to be accessible by unauthorized users or misconfigured as an open resolver will be subject to immediate review. - Proper Configuration:
It is the responsibility of the client to ensure their DNS server is properly configured and secure. If a DNS server is identified as improperly configured or causing network issues, it will be temporarily suspended until necessary configuration changes are made and confirmed. - Support Limitation:
Limited to no support will be provided for issues directly related to the configuration or operation of DNS servers. Clients are expected to have the technical expertise required to manage their own DNS server setups.
Port 25 and Mail Communication

Default Blocking Of Mail Ports:
-
All mail communication ports (e.g., Port 25) will be blocked by default to mitigate the risks of spam, abuse, and unauthorized usage.
-
Exceptions to this rule may be granted when a valid justification is provided that details the purpose and necessity for opening these mail ports.
Why Is Justification Required?
To ensure smooth administration and efficient tracking, we require justification for certain requests, such as opening Port 25 for email communication.
All IPs are automatically monitored from the moment the service is provisioned whether it is an IPv4 or IPv6 address.
If your IP is flagged, our system will notify you specifying where the issue was detected in the client area panel with color coded warnings. The first alert triggers a 5-day window for you to resolve the problem and inform us of the cause and the corrective actions taken. This window can be extended if needed by clicking the request for an extension button.
To maintain network integrity, the IP must be returned to us in the same clean state as it was originally provided. -
All requests for exceptions are subject to review and approval by our support personnel.

Additional Requirements for Crypto-Paid Accounts or Incomplete Registrations
Users who have paid using cryptocurrency or whose registration details remain incomplete must meet further requirements before mail ports can be opened:-
A Know Your Customer (KYC) form must be completed to verify user identity.
-
The user’s account profile must be updated to include complete and accurate registration details.
-
Failure to comply with these additional requirements will result in continued restriction of mail port access.
-
Monitoring And Audit:
-
All mail port activity will be monitored to ensure compliance with this policy.
-
An audit trail will be maintained for all requests and approvals related to opening mail ports.
-

Receipt of Abuse Notices:
-
If our network receives abuse reports from Spamhaus or other relevant third parties regarding misuse of Port 25, we will take immediate action to mitigate the risk.
-

Immediate Port Closure & Client Notification:
Upon receiving an abuse notice related to Port 25, we shall immediately close the port without prior notice and notify the affected client. The client will then have the following options:-
Rectify the issue by eliminating the abuse source within a timeframe of 5 days.
-
Pay an administrative cleanup fee of $25 (₦50,000) to expedite mitigation efforts on their behalf.
-

Failure to Take Corrective Action:
If neither corrective action nor payment of the cleanup fee is completed within 5 days, we reserve the right to immediately suspend the client’s service without further notice.
During this window, please contact us if the situation was caused by circumstances outside of reasonable control. -
Mandatory Cleanup Fee Upon Termination:
Should service termination occur due to unresolved abuse reports, the $25 (₦50,000) administrative cleanup fee will still be required as part of network remediation efforts. -
Service Ban for Non-Payment:
Failure to pay the administrative cleanup fee post-service termination will result in a conditional permanent ban, restricting the client from utilizing any of our services until full payment is received.
VNC Console Enabled by Default
VNC console is enabled by default upon the deployment of your server. This feature provides immediate graphical access for remote management, allowing you to monitor and control your server right out of the box.

Enabled by Default: Every newly deployed server comes with an active VNC console.

Immediate Access: Benefit from instant graphical remote access without the need for additional configuration.
- User Control: If you prefer not to use the VNC console, please disable it manually through your server management panel.

Windows Server Images and Licensing
Our services include providing hypervisor instances capable of running a Windows operating system. However, we do not provide or advertise the inclusion of Windows licenses with our servers. Users are solely responsible for obtaining and maintaining valid licenses for any Windows operating system or software they choose to install on their hypervisor instance.

When using our services:

BYOL (Bring Your Own License): Users must bring their own legally obtained and valid Windows Server license for use with their hypervisor instance.

Legal Use: The installation and use of Windows operating systems or related software must comply with all applicable laws, licensing agreements, and the terms of our [Terms and Conditions] and [Acceptable Use Policy].
- Client Responsibility: Users have full discretion over how they configure and manage their instances. Any actions or configurations must not violate our policies or engage in illegal activity.
